B\u00f6ylece art\u0131k \u00e7al\u0131\u015fma hayat\u0131nda klasik hizmet s\u00f6zle\u015fmesi t\u00fcrlerinin d\u0131\u015f\u0131nda i\u015f\u00e7i ve i\u015fverene esneklik sa\u011flayan yeni hizmet s\u00f6zle\u015fmesi t\u00fcrlerinin uygulama alan\u0131 buldu\u011fu g\u00f6r\u00fclmektedir.\n\n\u00dclkemizde \u00e7al\u0131\u015fma hayat\u0131 i\u00e7erisinde uygulama alan\u0131 bulan klasik s\u00f6zle\u015fme t\u00fcrleri d\u0131\u015f\u0131nda k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerinin \u00f6zel uygulama \u015fekli olan \u201c<strong>ba\u015fka (yan) i\u015fte \u00e7al\u0131\u015fma\u201d<\/strong>, \u201c<strong>\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma<\/strong> (work- on call)\u201d, \u201c<strong>i\u015f payla\u015f\u0131m\u0131<\/strong> (Job Sharing)\u201d \u00a0gibi yeni s\u00f6zle\u015fme t\u00fcrlerinin h\u0131zla yayg\u0131nla\u015fmaya ba\u015flad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.\n\nBu nedenle \u00e7al\u0131\u015fmam\u0131zda i\u015f hayat\u0131nda yeni uygulama alan\u0131 bulan \u201c<strong>ba\u015fka (yan) i\u015fte \u00e7al\u0131\u015fma\u201d<\/strong>, \u201c<strong>\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma<\/strong> (work- on call)\u201d, \u201c<strong>i\u015f payla\u015f\u0131m\u0131<\/strong> (Job Sharing)\u201d\u00a0 s\u00f6zle\u015fme t\u00fcrleri incelenmeye \u00e7al\u0131\u015f\u0131lacakt\u0131r. Bu kapsamda \u00f6ncelikle bu s\u00f6zle\u015fmelerin tan\u0131mlar\u0131 yap\u0131larak bu s\u00f6zle\u015fme t\u00fcrlerinin \u00f6zellikleri a\u00e7\u0131klanacakt\u0131r.\n<h2 data-fontsize=\"28\" data-lineheight=\"27\">\u0130\u015f Hukukunda Ba\u015fka \u0130\u015fte \u00c7al\u0131\u015fma, \u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fma ve \u0130\u015f Payla\u015f\u0131m\u0131<\/h2>\n<ol>\n \t<li><strong>KISM\u0130 S\u00dcREL\u0130 \u0130\u015e S\u00d6ZLE\u015eMELER\u0130<\/strong><\/li>\n<\/ol>\n<ol>\n \t<li><strong>K\u0131smi S\u00fcreli \u0130\u015f S\u00f6zle\u015fmesinin Tan\u0131m\u0131<\/strong><\/li>\n<\/ol>\nK\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmeleri en yayg\u0131n atipik i\u015f s\u00f6zle\u015fmeleridir.[1]\n\n\u0130\u015f s\u00f6zle\u015fmeleri uygulamada genellikle g\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere haftal\u0131k ve g\u00fcnl\u00fck i\u015f s\u00fcrelerine uygun olarak tam s\u00fcreli yap\u0131labilece\u011fi gibi baz\u0131 durumlarda k\u0131smi s\u00fcreli de yap\u0131labilmektedir. \u0130\u015f Kanunu m.13\/f.1\u2019e g\u00f6re; \u201c <em>\u0130\u015f\u00e7inin normal haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin, tam s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fan emsal i\u015f\u00e7iye g\u00f6re \u00f6nemli \u00f6l\u00e7\u00fcde daha az belirlenmesi durumunda s\u00f6zle\u015fme k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesidir<\/em>.\u201d \u00d6rn. haftan\u0131n belirli g\u00fcnlerinde tam g\u00fcn yada haftan\u0131n her g\u00fcn\u00fc belirli bir s\u00fcre \u00e7al\u0131\u015f\u0131lmas\u0131 \u015feklinde g\u00f6r\u00fclebilir.\n\nK\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesinin \u0130\u015f Kanunu m.13\/f.1\u2019de belirtilen tan\u0131m\u0131nda ge\u00e7en \u201c<em>\u00f6nemli \u00f6l\u00e7\u00fcde az<\/em>\u201d ifadesinden ne anla\u015f\u0131lmas\u0131 gerekti\u011fi 06.04.2004 tarihli \u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi m.6\u2019da belirtilmi\u015ftir. \u0130lgili madde uyar\u0131nca \u201c <em>\u0130\u015fyerinde tam s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile yap\u0131lan emsal \u00e7al\u0131\u015fman\u0131n \u00fc\u00e7te\u00a0 ikisi oran\u0131na kadar yap\u0131lan \u00e7al\u0131\u015fma k\u0131smi s\u00fcreli \u00e7al\u0131\u015fmad\u0131r<\/em>\u201d.\n\nAyn\u0131 \u015fekilde \u0130\u015f Kanunu m.13\/f.1\u2019de belirtilen tan\u0131m\u0131nda ge\u00e7en \u201c emsal i\u015f\u00e7i\u201d de Kanunu m.12\/f.sonda d\u00fczenlenmi\u015ftir. \u0130lgili maddeye g\u00f6re; \u201c <em>Emsal i\u015f\u00e7i, i\u015fyerinde ayn\u0131 veya benzeri i\u015fte tam s\u00fcreli \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7idir. \u0130\u015fyerinde b\u00f6yle bir i\u015f\u00e7i bulunmad\u0131\u011f\u0131 taktirde, o i\u015fkolunda \u015fartlara uygun i\u015fyerinde ayn\u0131 veya benzer i\u015fi \u00fcstlenen tam s\u00fcreli i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7i esas al\u0131n\u0131r.<\/em>\u201d\n<ol>\n \t<li><strong>K\u0131smi S\u00fcreli S\u00f6zle\u015fmelere Uygulanacak Kurallar<\/strong><\/li>\n<\/ol>\nKanun\u00a0 koyucu taraf\u0131ndan k\u0131smi s\u00fcreli \u00e7al\u0131\u015fanlar\u0131 korumak i\u00e7in \u201cfarkl\u0131 i\u015flem yasa\u011f\u0131\u201d getirilmi\u015ftir.[2] Farkl\u0131 i\u015flem yasa\u011f\u0131; \u0130\u015f Kanunu m.5\/f.2 ile \u201c <em>\u0130\u015fveren, esasl\u0131 sebepler olmad\u0131k\u00e7a tam s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i kar\u015f\u0131s\u0131nda k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7iye\u2026 farkl\u0131 i\u015flem yapamaz<\/em>.\u201d ve \u0130\u015f Kanunun m.13\/f.2 ile \u201c <em>K\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7i,ay\u0131r\u0131m\u0131 hakl\u0131 k\u0131lan bir neden olmad\u0131k\u00e7a,salt i\u015f s\u00f6zle\u015fmesinin k\u0131smi s\u00fcreli olmas\u0131ndan dolay\u0131 farkl\u0131 i\u015fleme tabi tutulamaz<\/em>\u201d \u015feklinde d\u00fczenlenmi\u015ftir.\n\n\u0130\u015f Kanunu m.13\/f.2\u2019de belirtildi\u011fi \u00fczere ayr\u0131m\u0131 hakl\u0131 k\u0131lan bir neden olmad\u0131k\u00e7a k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i, i\u015f s\u00f6zle\u015fmesinin k\u0131smi s\u00fcreli olmas\u0131ndan dolay\u0131\u00a0 farkl\u0131 muameleye tabi tutulamaz.\n\nK\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i tam s\u00fcreli emsal i\u015f\u00e7iye \u00f6denen asgari \u00fccretin veya ikramiyenin tamam\u0131n\u0131n \u00f6denmesini talep edemeyecek, sadece \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcreyle orant\u0131 \u00f6demenin yap\u0131lmas\u0131n\u0131 talep edebilecektir.[3]\n\nAyn\u0131 \u015fekilde k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i de b\u00f6l\u00fcnebilir haklardan[4]da (\u00f6rn. yakacak yard\u0131m\u0131) \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre ile orant\u0131l\u0131 olarak yararlanacakt\u0131r.[5]\n\nK\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmeleri; belirli s\u00fcreli veya belirsiz s\u00fcreli yap\u0131labilece\u011fi gibi s\u00fcrekli veya s\u00fcreli i\u015f i\u00e7inde yap\u0131labilir.[6]\n\n\u0130\u015f\u00e7i, ayn\u0131 anda de\u011fi\u015fik i\u015fyerlerindeki \u00e7al\u0131\u015fma s\u00fcresi yasal azami \u00e7al\u0131\u015fma s\u00fcresi olan 45 saati\u00a0 a\u015famamak \u015fart\u0131 ile birden fazla yerde k\u0131smi s\u00fcreli s\u00f6zle\u015fme yapabilir.[7]\n\n\u0130\u015f Kanunu m. 41 uyar\u0131nca i\u015f\u00e7inin fazla mesaiye \u00fccretine hak kazanabilmesi i\u00e7in i\u015f\u00e7inin haftal\u0131k 45 saati a\u015fmas\u0131 gerekiyor.\u00a0 E\u011fer i\u015f\u00e7inin haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi s\u00f6zle\u015fme ile 45 saatin alt\u0131nda belirlendiyse ve i\u015f\u00e7i s\u00f6zle\u015fmede belirlenen s\u00fcreden fazla \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131ysa burada fazla \u00e7al\u0131\u015fmadan de\u011fil, fazla s\u00fcrelerle \u00e7al\u0131\u015fmadan bahsedilir.[8] Bu kapsamda, i\u015f\u00e7inin bu fazla s\u00fcrelerle \u00e7al\u0131\u015fmas\u0131ndan dolay\u0131 i\u015f\u00e7iye 45 saate kadar olan k\u0131smi i\u00e7in %25\u00a0 \u00f6denir, ancak bu s\u00fcre 45 saati a\u015farsa, %50 fazla \u00e7al\u0131\u015fma \u00fccreti \u00f6denir.\n\n06.04.2004 tarihli \u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi m.8\/f.d ile Anayasaya ve \u0130\u015f Kanunu m. 41\u2019e ayk\u0131r\u0131 olarak k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7ilere fazla \u00e7al\u0131\u015fma ve fazla s\u00fcrelerle \u00e7al\u0131\u015fma yapt\u0131r\u0131lmas\u0131 yasaklanm\u0131\u015ft\u0131r. \u0130\u015f\u00e7inin onay\u0131 ile \u0130\u015f Kanunu m.41 in uygulanmas\u0131 m\u00fcmk\u00fcn olmal\u0131d\u0131r. [9]\n\nK\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7ilerin hafta tatili, ulusal bayram,genel tatil ile y\u0131ll\u0131k \u00fccretli izin haklar\u0131ndan yararlanmas\u0131 gerekir.[10] Nitekim 03.03.2004 tarihli Y\u0131ll\u0131k \u00dccretli \u0130zin Y\u00f6netmeli\u011fi m.13\/f.1 uyar\u0131nca \u201cy\u0131ll\u0131k \u00fccretli izin hakk\u0131\u201d \u201c<em>K\u0131smi s\u00fcreli ya da \u00e7a\u011fr\u0131 \u00fczerine i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fanlar y\u0131ll\u0131k \u00fccretli izin hakk\u0131ndan tam s\u00fcreli \u00e7al\u0131\u015fanlar gibi yararlan\u0131r ve fark\u0131 i\u015fleme tabi tutulamaz.\u201d <\/em>\u015feklinde h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Ancak k\u0131smi \u00e7al\u0131\u015fmada \u0130\u015f Kanunu ile belirtilen g\u00fcnl\u00fck i\u015f s\u00fcrelerine uygun bir \u00e7al\u0131\u015fma s\u00f6z konusu de\u011fildir, bu nedenle i\u015f\u00e7inin k\u0131smi \u00e7al\u0131\u015fma sonucunda hafta tatili \u00fccretine hak kazanaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclemez.[11] K\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7inin \u00e7al\u0131\u015faca\u011f\u0131 g\u00fcn ulusal bayrama veya genel tatil g\u00fcn\u00fcne rastlamas\u0131 \u015fart\u0131 ile i\u015f\u00e7inin s\u00f6z konusu g\u00fcnlere ait tatil \u00fccretlerinden yararlanmas\u0131 gerekmektedir.[12]\n\nK\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi kapsam\u0131nda \u00e7al\u0131\u015fan i\u015f\u00e7ilerin k\u0131dem tazminat\u0131n\u0131n hesaplanmas\u0131nda o i\u015fyerinde \u00e7al\u0131\u015f\u0131lmayan g\u00fcnlerde dahil olmak \u00fczere hizmet s\u00f6zle\u015fmesinin devam etti\u011fi s\u00fcre dikkate al\u0131narak hesaplan\u0131r.[13] Ancak Yarg\u0131tay\u2019\u0131n bu konudaki uygulamalar\u0131 ilk ba\u015fta istikrar g\u00f6stermezken daha sonra hizmet s\u00f6zle\u015fmesinin devam\u0131 s\u00fcresini dikkate alm\u0131\u015ft\u0131r.[14]\n\nK\u0131smi s\u00fcreli \u00e7al\u0131\u015fanlar, i\u015f s\u00f6zle\u015fmelerinin feshinde tam s\u00fcreli \u00e7al\u0131\u015fanlara uygulanan h\u00fck\u00fcmler uygulan\u0131r.[15]\n\nAyr\u0131ca k\u0131smi s\u00fcreli \u00e7al\u0131\u015fanlar toplu i\u015f hukukuna ili\u015fkin haklardan yararlan\u0131r, sendikalara \u00fcye olabilirler ve yasal greve kat\u0131labilirler.[16]\n\n<strong>\u00a0<\/strong>\n<ol>\n \t<li><strong>KISM\u0130 S\u00dcREL\u0130 \u0130\u015e S\u00d6ZLE\u015eMELER\u0130N\u0130N \u00d6ZEL T\u00dcRLER\u0130<\/strong><\/li>\n<\/ol>\nG\u00fcn\u00fcm\u00fczde ortaya \u00e7\u0131kan ekonomik ve teknolojik geli\u015fmeler sonucunda esnekle\u015fen i\u015f hukukunda yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z klasik\u00a0 k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmeleri\u00a0 d\u0131\u015f\u0131nda k\u0131smi s\u00fcreli s\u00f6zle\u015fmelerin \u00e7e\u015fitli \u00f6zel t\u00fcrleri de uygulamada g\u00f6r\u00fclmeye ba\u015flanm\u0131\u015ft\u0131r.\n\n<strong>\u00a0<\/strong>\n<ol>\n \t<li><strong>BA\u015eKA \u0130\u015eTE \u00c7ALI\u015eMA<\/strong><\/li>\n<\/ol>\n<ol>\n \t<li><strong>Genel Olarak<\/strong><\/li>\n<\/ol>\n\u00dclkemizde i\u015f\u00e7i \u00fccretlerinin d\u00fc\u015f\u00fck olmas\u0131 sonucunda ge\u00e7im s\u0131k\u0131nt\u0131s\u0131 \u00e7eken ve halen bir i\u015fte \u00e7al\u0131\u015fan i\u015f\u00e7i as\u0131l i\u015finin yan\u0131 s\u0131ra yan i\u015f niteli\u011finde olan ikinci i\u015fte \u00e7al\u0131\u015fmak veya ayn\u0131 \u015fekilde emekli maa\u015f\u0131n\u0131n d\u00fc\u015f\u00fck olmas\u0131 sonucunda ekonomik s\u0131k\u0131nt\u0131 \u00e7eken emekli i\u015f\u00e7i tekrar \u00e7al\u0131\u015fmak zorunda kalmaktad\u0131r. Bu nedenle \u00fclkemizde ba\u015fka i\u015fte \u00e7al\u0131\u015fma yayg\u0131nla\u015fmaktad\u0131r. Ancak <strong>\u201cba\u015fka i\u015fte \u00e7al\u0131\u015fma\u201d<\/strong> \u0130\u015f Kanun\u2019unda d\u00fczenlenmemi\u015ftir. Ancak d\u00fczenlenmesine bir engel bulunmamaktad\u0131r.[17]\n\n<strong>\u00a0\u201cBa\u015fka i\u015f\u201d<\/strong>; i\u015f\u00e7i ile i\u015fveren aras\u0131ndaki as\u0131l i\u015f ili\u015fkisinin yan\u0131nda yasal d\u00fczenlemelerin imkan verdi\u011fi \u00f6l\u00e7\u00fcde \u00fccret kar\u015f\u0131l\u0131\u011f\u0131 yap\u0131lan ikinci bir i\u015f olarak tan\u0131mlanabilir.[18] Hafta be\u015f g\u00fcn azami yasal haftal\u0131k i\u015f s\u00fcresi doldurulmadan \u00e7al\u0131\u015fan i\u015f\u00e7i haftan\u0131n alt\u0131nc\u0131 g\u00fcn\u00fc ba\u015fka bir i\u015fverenin i\u015fyerinde \u00e7al\u0131\u015fabilir. \u00d6rn. as\u0131l i\u015fini g\u00f6rmek suretiyle bir i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7i ak\u015famlar\u0131 bir lokantada bula\u015f\u0131k y\u0131kayarak ba\u015fka i\u015fte \u00e7al\u0131\u015fabilir.\n\nHer ba\u015fka i\u015f bir k\u0131smi s\u00fcreli i\u015f akdi niteli\u011findedir.\n\nBa\u015fka i\u015f; i\u015f\u00e7i k\u0131smi s\u00fcreli bir i\u015fte \u00e7al\u0131\u015f\u0131rken bir ba\u015fka i\u015f yerinde de k\u0131smi s\u00fcre ile \u00e7al\u0131\u015fmas\u0131 \u015feklinde ortaya \u00e7\u0131kabilece\u011fi gibi, i\u015f\u00e7in bir i\u015fyerinde tam g\u00fcn \u00e7al\u0131\u015f\u0131rken bir ba\u015fka i\u015fyerinde k\u0131smi s\u00fcreli \u00e7al\u0131\u015fmas\u0131 ile de ortaya \u00e7\u0131kabilir.\n\n\u201cBa\u015fka i\u015fte \u00e7al\u0131\u015fma\u201d ile \u201cek i\u015f\u201d in kar\u0131\u015ft\u0131r\u0131lmamas\u0131 gerekir. Ayn\u0131 i\u015fverene ait sinemada \u00e7al\u0131\u015fan i\u015f\u00e7i as\u0131l i\u015fine ek olarak bo\u015f zamanlar\u0131nda yer g\u00f6steriyorsa s\u00f6z konusu i\u015f\u00e7inin i\u015fi ek i\u015f olarak de\u011ferlendirilir. Ba\u015fka i\u015fte \u00e7al\u0131\u015fmada i\u015f\u00e7i farkl\u0131 i\u015fverene ba\u011fl\u0131 olarak \u00e7al\u0131\u015fmaktad\u0131r.\n<ol start=\"2\">\n \t<li><strong>Ba\u015fka \u0130\u015fte \u00c7al\u0131\u015fma \u015eartlar\u0131<\/strong><\/li>\n<\/ol>\nBa\u015fka i\u015fin varl\u0131\u011f\u0131ndan s\u00f6z edebilmek i\u00e7in ilk \u015fart; bir as\u0131l i\u015f akdinin varl\u0131\u011f\u0131 gerekmekte olup e\u011fer bir i\u015f di\u011fer i\u015fe g\u00f6re aslilik-ferilik ili\u015fkisi i\u00e7inde de\u011filse bir yan i\u015fin varl\u0131\u011f\u0131ndan de\u011fil birden fazla k\u0131smi s\u00fcreli i\u015f akdinin varl\u0131\u011f\u0131ndan s\u00f6z edilir.[19] Bir ba\u015fka ifade ile; k\u0131smi s\u00fcreli \u00e7al\u0131\u015fman\u0131n ba\u015fka i\u015f olarak de\u011ferlendirilebilmesi i\u00e7in i\u015f\u00e7i a\u00e7\u0131s\u0131nda i\u015fg\u00fcc\u00fcn\u00fc bask\u0131n olarak kulland\u0131\u011f\u0131 ve \u00fccret a\u00e7\u0131s\u0131ndan bask\u0131n rol oynayan as\u0131l bir \u00e7al\u0131\u015fma ili\u015fkisinin varl\u0131\u011f\u0131 gerekmektedir. Bu nedenle her ba\u015fka i\u015fte \u00e7al\u0131\u015fma k\u0131smi s\u00fcreli \u00e7al\u0131\u015fma olmakla beraber her k\u0131smi s\u00fcreli \u00e7al\u0131\u015fma ba\u015fka i\u015fte \u00e7al\u0131\u015fma olmad\u0131\u011f\u0131n\u0131 s\u00f6yleyebiliriz.\n\nBa\u015fka i\u015fin varl\u0131\u011f\u0131n\u0131n ikinci \u015fart\u0131; i\u015f\u00e7inin as\u0131l i\u015f ili\u015fkisi ile yasal azami \u00e7al\u0131\u015fma s\u00fcresini[20] doldurmamas\u0131 gerekmektedir.[21] \u0130\u015f\u00e7i, as\u0131l i\u015finde yasal azami \u00e7al\u0131\u015fma s\u00fcresini doldurmad\u0131\u011f\u0131 oranda ba\u015fka i\u015f m\u00fcmk\u00fcn ve ge\u00e7erlidir.[22] Bir ba\u015fka ifade ile; i\u015f\u00e7inin as\u0131l i\u015fteki kalan haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi kadar \u00e7al\u0131\u015fma ili\u015fkisi i\u00e7ine girebilecektir. Haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi 45 saat oldu\u011funa g\u00f6re, i\u015f\u00e7i, as\u0131l \u00e7al\u0131\u015fma ili\u015fkisinin 45 saatin alt\u0131nda olmas\u0131 bakiye haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi kadar ba\u015fka i\u015fte \u00e7al\u0131\u015fmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Aksi taktirde as\u0131l i\u015f ile ba\u015fka i\u015fteki \u00e7al\u0131\u015fma s\u00fcresinin kanunda belirtilen azami miktar\u0131 a\u015fm\u0131\u015f olacak ve i\u015f\u00e7i i\u00e7in sa\u011fl\u0131k ve g\u00fcvenlik y\u00f6n\u00fcnden sak\u0131nca yaratacakt\u0131r.[23] Haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi olan 45 saatin a\u015f\u0131lmas\u0131 durumunda, \u0130\u015f Kanununda i\u015f\u00e7inin haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin belirlendi\u011fi emredici hukuk kural\u0131na\u00a0 ayk\u0131r\u0131l\u0131k olu\u015facak,ancak i\u015f\u00e7inin 45 saat \u00e7al\u0131\u015fmas\u0131na ayk\u0131r\u0131l\u0131k te\u015fkil eden i\u015f s\u00f6zle\u015fmesinin TBK m. 27 uyar\u0131nca kesin h\u00fck\u00fcms\u00fcz say\u0131lmas\u0131 \u0130\u015f Kanunu ile korunmak isteyen i\u015f\u00e7inin aleyhine sonu\u00e7 do\u011furacakt\u0131r. Bu nedenle i\u015f s\u00f6zle\u015fmesininsadece 45 saati a\u015fan k\u0131sm\u0131n\u0131n ge\u00e7ersiz say\u0131lmas\u0131 m\u00fcmk\u00fcn olacakt\u0131r. Ayr\u0131ca\u00a0 i\u015f\u00e7ilerin \u00e7al\u0131\u015fma s\u00fcresi s\u00fcrelerine getierilen s\u0131n\u0131r sadece haftal\u0131k s\u0131n\u0131rlama olmay\u0131p \u0130\u015fK m. 63\/f.2 ve \u00c7SY m.4\/f.3 ile eg\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresinin 11 saati a\u015famayaca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.\n\n\u0130\u015f\u00e7inin ba\u015fka i\u015f yapmas\u0131 sadakat borcuna ayk\u0131r\u0131 olmamas\u0131 gerekmekte olup aksi halde ba\u015fka\u00a0 i\u015fte \u00e7al\u0131\u015fma akdi ge\u00e7ersiz say\u0131lacakt\u0131r.[24] \u0130\u015f\u00e7i hizmetini i\u015fverenin yarar\u0131na uygun olarak yapmas\u0131 ve i\u015fverene zarar verebilecek hareketlerden ka\u00e7\u0131nmas\u0131 gerekmektedir.[25] \u0130\u015f\u00e7inin daha sonra farkl\u0131 bir i\u015fverenle ba\u015fka i\u015f ili\u015fkisi i\u00e7ine girmesi halinde bu durumun ilk i\u015fveren aleyhine sonu\u00e7lar do\u011furmamas\u0131 gerekir. \u00d6rn. bir g\u00fczellik &#8220;\u0131n\u0131n birden fazla g\u00fczellik merkezinde \u00e7al\u0131\u015fmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Ancak g\u00fczellik &#8220;\u0131n\u0131n, di\u011fer i\u015fverenin m\u00fc\u015fterilerine cilt bak\u0131mlar\u0131n\u0131 as\u0131l i\u015fverenin yerinde yapt\u0131rabileceklerini \u00f6nermesi sadakat borcunun ihlalini olu\u015fturacakt\u0131r. \u0130\u015f\u00e7inin ilk i\u015fveren yan\u0131nda raporlu olmas\u0131 sebebiyle \u00e7al\u0131\u015fmad\u0131\u011f\u0131 s\u0131rada di\u011fer bir i\u015fveren ile ikinci bir i\u015f ili\u015fkisi i\u00e7erisine girmesi halinde Yarg\u0131tay i\u015f\u00e7inin sadakat borcunu ihalal etti\u011fi gerek\u00e7esi ile i\u015fveren taraf\u0131ndan s\u00f6zle\u015fmenin hakl\u0131 nedenle fesih edilmesinin m\u00fcmk\u00fcn oldu\u011funa karar verilmi\u015ftir.[26]\n\nAyn\u0131 \u015fekilde ba\u015fka i\u015fte \u00e7al\u0131\u015fma i\u015fveren a\u00e7\u0131s\u0131ndan haks\u0131z rekabet do\u011furmamas\u0131 gerekmektedir.[27] Rekabet etmeme borcu i\u015f s\u00f6zle\u015fmesinin devam\u0131 s\u00fcresince sadakat borcu kapsam\u0131nda de\u011ferlendirilir. \u0130\u015f\u00e7i \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre boyunca i\u015fverene ait mesleki ve ticari s\u0131rlar\u0131 kullanarak ba\u015fka i\u015fveren alt\u0131nda \u00e7al\u0131\u015fmas\u0131 rekabet borcunun ihlali anlam\u0131na gelecektir.\n\nAyr\u0131ca ba\u015fka i\u015fte \u00e7al\u0131\u015fma i\u015f\u00e7inin as\u0131l i\u015findeki \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fc olumsuz etkilememelidir.[28]\n<ol start=\"3\">\n \t<li><strong>Ba\u015fka \u0130\u015fte \u00a0\u00c7al\u0131\u015fma Serbestisi ve S\u0131n\u0131rlanmas\u0131<\/strong><\/li>\n<\/ol>\n\u0130\u015f\u00e7inin ba\u015fka i\u015fte \u00e7al\u0131\u015fmas\u0131n\u0131n s\u00f6zle\u015fme h\u00fck\u00fcmleri ile yasaklanabilece\u011fi veya s\u0131n\u0131rlanabilece\u011fi ileri s\u00fcr\u00fclebilirse de, b\u00f6yle bir h\u00fck\u00fcm MK. m. 23[29] uyar\u0131nca i\u015f\u00e7inin sahip oldu\u011fu ki\u015filik haklar\u0131na ayk\u0131r\u0131l\u0131k te\u015fkil edece\u011fi gerek\u00e7esiyle ge\u00e7ersiz say\u0131lacakt\u0131r. [30] Bu t\u00fcr yasaklama ve s\u0131n\u0131rlamalar\u0131n hukuki ge\u00e7erlili\u011fini s\u0131n\u0131rl\u0131 durumlar i\u00e7in kabul etmek gerekecektir. [31] \u00a0\u0130\u015fverenin veya i\u015f\u00e7inin hakl\u0131 bir \u00e7\u0131kar\u0131n\u0131n korunmas\u0131n\u0131 sa\u011flamak i\u00e7in ba\u015fka (yan) i\u015fte \u00e7al\u0131\u015fmas\u0131 yasa\u011f\u0131n\u0131n s\u00f6zle\u015fmede d\u00fczenlenmesini ge\u00e7erli kabul etmek gerekir.[32] \u00d6rn: i\u015f\u00e7inin ba\u015fka i\u015fte \u00e7al\u0131\u015fmas\u0131n\u0131n i\u015fveren a\u00e7\u0131s\u0131ndan haks\u0131z rekabetin do\u011fmas\u0131na yol a\u00e7mas\u0131 veya toplu i\u015f s\u00f6zle\u015fmesine i\u015f\u00e7iyi korumak i\u00e7in i\u015f\u00e7i sendikas\u0131 taraf\u0131ndan belirli \u00e7al\u0131\u015fma saati toplam\u0131n\u0131 asgari i\u015f s\u00fcresi olarak toplu i\u015f s\u00f6zle\u015fmesinde d\u00fczenleyebilir.\n\n\u0130\u015f\u00e7i sendikalar\u0131, ba\u015fka i\u015fte \u00e7al\u0131\u015fma yasa\u011f\u0131na ili\u015fkin h\u00fck\u00fcmlerin toplu i\u015f s\u00f6zle\u015fmelerinde yer almas\u0131n\u0131 isteyebilir, ancak <em>\u201ci\u015f\u00e7inin \u00f6zg\u00fcrl\u00fck alan\u0131na girdi\u011fi ve toplu i\u015f s\u00f6zle\u015fmesi \u00f6zerkli\u011fini a\u015ft\u0131\u011f\u0131 gerek\u00e7esiyle ge\u00e7ersiz say\u0131ld\u0131\u011f\u0131 ve i\u015f\u00e7iyi ba\u011flamad\u0131\u011f\u0131 kabul edilmektedir\u201d<\/em>.[33]\n<ol>\n \t<li><strong>\u00c7A\u011eRI \u00dcZER\u0130NE \u00c7ALI\u015eMA<\/strong><\/li>\n<\/ol>\n<strong>\u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fma<\/strong>\n\n<strong>Madde 14:<\/strong> \u201c <em>Yaz\u0131l\u0131 s\u00f6zle\u015fme ile\u00a0 i\u015f\u00e7inin yapmay\u0131 \u00fcstlendi\u011fi i\u015fle ilgili olarak kendisine ihtiya\u00e7 duyulmas\u0131 halinde i\u015f g\u00f6rme ediminin yerine getirilece\u011finin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 i\u015f ili\u015fkisi, \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayal\u0131 k\u0131smi s\u00fcreli bir i\u015f s\u00f6zle\u015fmesidir.<\/em>\n\n<em>Hafta, ay veya y\u0131l gibi bir zaman dilimi i\u00e7inde i\u015f\u00e7inin ne kadar s\u00fcreyle \u00e7al\u0131\u015faca\u011f\u0131n\u0131 taraflar belirlemedikleri takdirde, haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi yirmi saat kararla\u015ft\u0131r\u0131lm\u0131\u015f say\u0131l\u0131r. \u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015ft\u0131r\u0131lmak i\u00e7in belirlenen s\u00fcrede i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131ls\u0131n veya \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131n \u00fccrete hak kazan\u0131r.<\/em>\n\n<em>\u0130\u015f\u00e7iden i\u015f g\u00f6rme borcunu yerine getirmesini \u00e7a\u011fr\u0131 yoluyla talep hakk\u0131na sahip olan i\u015fveren, bu \u00e7a\u011fr\u0131y\u0131, aksi kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a, i\u015f\u00e7inin \u00e7al\u0131\u015faca\u011f\u0131 zamandan en az d\u00f6rt g\u00fcn \u00f6nce yapmak zorundad\u0131r. S\u00fcreye uygun \u00e7a\u011fr\u0131 \u00fczerine i\u015f\u00e7i i\u015f g\u00f6rme edimini yerine getirmekle y\u00fck\u00fcml\u00fcd\u00fcr. S\u00f6zle\u015fmede g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi kararla\u015ft\u0131r\u0131lmam\u0131\u015f ise, i\u015fveren her \u00e7a\u011fr\u0131da i\u015f\u00e7iyi g\u00fcnde en az d\u00f6rt saat \u00fcst \u00fcste \u00e7al\u0131\u015ft\u0131rmak zorundad\u0131r.<\/em>\u201d\n<ol>\n \t<li><strong>Genel Olarak<\/strong><\/li>\n<\/ol>\n\u0130\u015f Kanununda g\u00fcn\u00fcm\u00fczde giderek yayg\u0131n bir hale gelen lokanta, oteller ile e\u011flence yerlerinde \u201cekstra i\u015f\u00e7i\u201d ad\u0131 alt\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7iler ile uygulamada g\u00f6r\u00fclen[34] <strong>\u201c\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya\u201d<\/strong> da yer verilmi\u015ftir. K\u0131sm\u0131 s\u00fcreli i\u015f s\u00f6zle\u015fmelerinin \u00f6zel bir uygulama \u015fekli olan <strong>\u201c\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma\u201d;<\/strong> \u0130K m.14\u2019de d\u00fczenlenmi\u015ftir. \u0130K m.14\/f.1\u2019de<strong>\u201c\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma\u201d;<\/strong> \u201c<em>Yaz\u0131l\u0131 s\u00f6zle\u015fme ile\u00a0 i\u015f\u00e7inin yapmay\u0131 \u00fcstlendi\u011fi i\u015fle ilgili olarak kendisine ihtiya\u00e7 duyulmas\u0131 halinde i\u015f g\u00f6rme ediminin yerine getirilece\u011finin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 i\u015f ili\u015fkisi, \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayal\u0131 k\u0131smi s\u00fcreli bir i\u015f s\u00f6zle\u015fmesidir\u201d <\/em>\u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r.\n\nBir ba\u015fka ifade ile <strong>\u201c\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma\u201d;<\/strong>\u00a0 i\u015f\u00e7inin \u00fcstlendi\u011fi i\u015fin g\u00f6r\u00fclmesi ediminin, i\u015fin \u00e7\u0131kt\u0131\u011f\u0131 zamanlarda, i\u015fveren taraf\u0131ndan belirli bir s\u00fcre \u00f6nce i\u015f\u00e7iye bildirmek ko\u015fulu ile i\u015f\u00e7inin \u00e7a\u011fr\u0131lmas\u0131 esas\u0131na dayan\u0131larak i\u015f\u00e7i taraf\u0131ndan yerine getirilmesidir. \u0130\u015f\u00e7i <strong>kendisine ihtiya\u00e7 duyulmas\u0131 halinde <\/strong>i\u015f g\u00f6rme edimini yerine getirecektir. Bu nedenle i\u015f\u00e7inin her g\u00fcn \u00e7a\u011fr\u0131lmamas\u0131 gerekmekte olup aksi durum \u0130K m.14 ayk\u0131r\u0131l\u0131k te\u015fkil edecektir.[35]\n\n\u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma daha \u00e7ok turizm\u00a0 ve e\u011flence sekt\u00f6r\u00fcnde g\u00f6r\u00fclmektedir.[36] \u00d6rn; rehberler, terc\u00fcmanlar. Ayr\u0131ca uygulamada S\u00fct End\u00fcstrisi Kurumunda da \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma g\u00f6r\u00fclmektedir.[37]\n<ol start=\"2\">\n \t<li><strong>\u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fman\u0131n Ger\u00e7ekle\u015fme Ko\u015fullar\u0131<\/strong><\/li>\n<\/ol>\n\u0130\u015f Kanun\u2019unun\u00a0 m.10\/f.2 uyar\u0131nca\u00a0 \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmay\u0131 d\u00fczenleyen ayn\u0131 Kanunun\u00a0 m.14\u2019si s\u00fcreksiz i\u015flerde[38]\u00a0 uygulanmayacakt\u0131r.[39]\n\n\u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmalarda s\u00f6zle\u015fmenin taraflar\u0131nca hafta, ay veya y\u0131l gibi zaman dilimi i\u00e7inde i\u015f\u00e7inin toplam ne kadar s\u00fcre \u00e7al\u0131\u015faca\u011f\u0131 belirlenir. \u0130\u015f\u00e7inin ne kadar s\u00fcre ile \u00e7al\u0131\u015faca\u011f\u0131 s\u00f6zle\u015fmenin taraflar\u0131nca belirlenmediyse \u0130K m.14\/f.2 uyar\u0131nca haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi yirmi saat olarak kararla\u015ft\u0131r\u0131lm\u0131\u015f say\u0131l\u0131r. Taraflar\u0131n aksini belirleyebilmesi s\u00f6z konusu oldu\u011fu i\u00e7in \u201c<strong>haftal\u0131k yirmi saatlik s\u00fcre<\/strong>\u201d yedek hukuk kural\u0131 niteli\u011fi ta\u015f\u0131r.[40] \u00a0B\u00f6ylece taraflar haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresini yirmi saatin alt\u0131nda veya \u00fcst\u00fcnde belirleyebilirler. Ancak yirmi saatin alt\u0131nda belirlemek anlam ifade etmez.\n\n\u0130\u015f K m.14\/f.2 ile \u201c\u2026<em>\u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmak i\u00e7in belirlenen s\u00fcrede i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131ls\u0131n yada \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131n \u00fccrete hak kazan\u0131r<\/em>.\u201d \u015feklinde getirilen d\u00fczenleme ile i\u015f\u00e7inin \u00fccreti g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r.[41]-[42]\u00a0 Bu nedenle \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayanan i\u015f s\u00f6zle\u015fmesinde kural olarak yirmi saat haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin esas al\u0131naca\u011f\u0131 kabul edilebilir.\n\n\u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi m.6 uyar\u0131nca; k\u0131smi s\u00fcreli \u00e7al\u0131\u015fma, i\u015fyerinde tam s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile yap\u0131lan emsal \u00e7al\u0131\u015fman\u0131n \u00fc\u00e7te\u00a0 ikisi oran\u0131na kadar yap\u0131labilir. \u00d6rn; i\u015f yerinde k\u0131rk be\u015f saat tam s\u00fcreli \u00e7al\u0131\u015fma yap\u0131l\u0131yorsa k\u0131smi s\u00fcreli s\u00f6zle\u015fmelerde haftal\u0131k azami s\u0131n\u0131r otuz saattir. \u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayal\u0131 s\u00f6zle\u015fme de k\u0131smi s\u00fcreli bir i\u015f s\u00f6zle\u015fmesidir. Bu nedenle \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayal\u0131 s\u00f6zle\u015fmede\u00a0 taraflar haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresini otuz saatin \u00fcst\u00fcnde belirleyemez.\n\nAyr\u0131ca kanun koyucu taraf\u0131ndan asgari s\u00fcrenin ne kadar oldu\u011funa dair bir d\u00fczenleme getirilmemekle beraber \u0130\u015fK m.14\/f.3\u2019 de i\u015f\u00e7inin her \u00e7a\u011fr\u0131da en az d\u00f6rt saat \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 gerekti\u011finin belirtilmesi sonucu olarak asgari s\u00fcrenin hafta en az d\u00f6rt saat olabilece\u011fi s\u00f6ylenebilir.[43]\n\n\u0130\u015f\u00e7inin i\u015f g\u00f6rme edimini ne zaman ve ne kadar s\u00fcre ile (i\u015f s\u00fcresinin uzunlu\u011fu) yerine getirece\u011fini belirlemek i\u015fverene ait olup bu i\u015fveren taraf\u0131ndan \u00e7a\u011fr\u0131 yolu ile ger\u00e7ekle\u015ftirilir.[44] Ancak \u0130K m.14\/f.3 ile kanun koyucu taraf\u0131ndan i\u015fverene \u00e7a\u011fr\u0131y\u0131 belirli bir s\u00fcre \u00f6nce yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilmi\u015ftir.[45] \u0130K m.14\/3 uyar\u0131nca s\u00f6z konusu \u201c<em>\u00e7a\u011fr\u0131n\u0131n,<strong>aksi kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a<\/strong>, i\u015f\u00e7inin \u00e7al\u0131\u015faca\u011f\u0131 zamandan en az d\u00f6rt g\u00fcn \u00f6nce yap\u0131lmas\u0131 zorundad\u0131r. S\u00fcreye uygun \u00e7a\u011fr\u0131 \u00fczerine i\u015f\u00e7i i\u015f g\u00f6rme edimini yerine getirmekle y\u00fck\u00fcml\u00fcd\u00fcr<\/em>.\u201d \u00a0S\u00f6z konusu h\u00fck\u00fcm yedek hukuk kural\u0131 niteli\u011finde olup taraflar aralar\u0131nda anla\u015farak d\u00f6rt g\u00fcnden daha fazla bir \u00e7a\u011fr\u0131 s\u00fcresi kararla\u015ft\u0131rabilecekleri gibi daha k\u0131sa bir \u00e7a\u011fr\u0131 s\u00fcresi de belirleyebilirler.[46]\n\n\u0130K m.14\/f.3 g\u00f6re; \u201c <em>S\u00f6zle\u015fmede g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi kararla\u015ft\u0131r\u0131lmam\u0131\u015f ise, i\u015fveren her \u00e7a\u011fr\u0131da i\u015f\u00e7iyi g\u00fcnde en az d\u00f6rt saat \u00fcst \u00fcste \u00e7al\u0131\u015ft\u0131rmak zorundad\u0131r.\u201d <\/em>B\u00f6ylece \u201c<em>i\u015fverenin talimat verme hakk\u0131 da<strong>[47]<\/strong> \u00a0s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r.\u201d<strong>[48]<\/strong><\/em>\n\nKanun koyucu taraf\u0131ndan, gerek \u00e7a\u011fr\u0131n\u0131n aksi kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a enaz d\u00f6rt g\u00fcn \u00f6nce yap\u0131lmas\u0131 gerekse i\u015f\u00e7inin her \u00e7a\u011fr\u0131da en az d\u00f6rt saat \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fine ili\u015fkin d\u00fczenlemenin getirilmesi ile i\u015f\u00e7inin g\u00fcvence alt\u0131na al\u0131nmak istendi\u011fi d\u00fc\u015f\u00fcn\u00fclmektedir.\n\n\u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayal\u0131 i\u015f s\u00f6zle\u015fmelerinin taraflar\u0131n\u0131n hak ve y\u00fck\u00fcml\u00fcl\u00fcklerinde a\u00e7\u0131kl\u0131k sa\u011flamas\u0131 bak\u0131m\u0131ndan yaz\u0131l\u0131 yap\u0131lmas\u0131 zorunlulu\u011fu getirilmi\u015ftir. Ancak s\u00f6z konusu s\u00f6zle\u015fmenin yaz\u0131l\u0131 yap\u0131lmam\u0131\u015f olmas\u0131 s\u00f6zle\u015fmeyi ge\u00e7ersiz yapmaz.[49]-[50] Bir ba\u015fka ifade ile; yaz\u0131l\u0131 \u015fekil ispat \u015fart\u0131 olup yaz\u0131l\u0131 s\u00f6zle\u015fmenin olmad\u0131\u011f\u0131 durumlarda \u0130K m.14\u2019de h\u00fck\u00fcm alt\u0131na al\u0131nan hususlar uygulama alan\u0131 bulacakt\u0131r.[51] \u00d6rn. yaz\u0131l\u0131 s\u00f6zle\u015fmenin olmad\u0131\u011f\u0131 ve durumda i\u015fveren i\u015f\u00e7iyi en az d\u00f6rt saat \u00fcst \u00fcste \u00e7al\u0131\u015ft\u0131rmal\u0131, \u00e7al\u0131\u015ft\u0131rmasa bile \u00fccretini \u00f6demelidir.\n<ol start=\"3\">\n \t<li><strong>\u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fmay\u0131 D\u00fczenleyen \u0130\u015f Kanunu m.14\u2019\u00fcn Anayasaya Uygunlu\u011fu Sorunu<\/strong><\/li>\n<\/ol>\n4857 say\u0131l\u0131 \u0130\u015f Kanununun hemen kabul\u00fcnden sonra baz\u0131 di\u011fer maddelerle birlikte \u0130\u015f Kanunun m.14\u2019\u00fcn Anayasaya ayk\u0131r\u0131 oldu\u011fu iddias\u0131 ile h\u00fckm\u00fcn iptali amac\u0131yla Anayasa Mahkemesinde dava a\u00e7\u0131lm\u0131\u015ft\u0131r.S\u00f6z konusu madde \u00e7a\u011fr\u0131 \u00fczerinde \u00e7al\u0131\u015fanlar\u0131n alacaklar\u0131 \u00fccretlerin asgari \u00fccretin alt\u0131nda olaca\u011f\u0131, yapt\u0131klar\u0131 i\u015fe oranla adil \u00fccret alamayacaklar\u0131, bu i\u015f\u00e7ilerin \u00f6rg\u00fctlenme ve sendikal \u00e7al\u0131\u015fmalara kat\u0131lma hakk\u0131ndan yeterince yararlanamayaca\u011f\u0131, emeklilik ve sigorta haklar\u0131ndan yararlan\u0131lmas\u0131n\u0131n fiilen ortadan kalkt\u0131\u011f\u0131 gerek\u00e7eleri ile Anayasan\u0131n 2,5,11,13,55,56,60 maddelerine ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esi ile h\u00fckm\u00fcn iptali talep edilmi\u015ftir.[52]\n\nAncak Anayasa Mahkemesi taraf\u0131ndan, \u00e7a\u011fr\u0131 \u00fczerinde \u00e7al\u0131\u015fman\u0131n esnek \u00e7al\u0131\u015fma t\u00fcrlerinden biri oldu\u011fu, uygulaman\u0131n 4857 say\u0131l\u0131 \u0130\u015f Kanunu y\u00fcr\u00fcrl\u00fc\u011fe girmeden \u00f6nce de uygulamada Yarg\u0131tay \u0130\u00e7tihatlar\u0131 ile fiilen kabul edilmi\u015f oldu\u011fu, \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fanlar\u0131n sendikalara \u00fcye olmak ve sendikal faaliyetlere kat\u0131lmak konusunda di\u011fer i\u015f\u00e7ilerle\u00a0 bir fark\u0131n\u0131n bulunmad\u0131\u011f\u0131, \u00e7a\u011fr\u0131 \u00fczerine ve normalden daha az \u00e7al\u0131\u015fan i\u015f\u00e7inin daha d\u00fc\u015f\u00fck \u00fccret almas\u0131n\u0131n \u00fccrette adalet ilkesinin gere\u011fi oldu\u011fu,yeterli prim \u00f6denmi\u015f olmas\u0131 halinde sa\u011fl\u0131k sigortas\u0131ndan faydalanabilece\u011fi,emeklilik haklar\u0131ndan yararlanmalar\u0131n\u0131n \u0130\u015f Kanunu ile ilgili olmad\u0131\u011f\u0131, sosyal g\u00fcvenlik mevzuat\u0131 ile ilgili oldu\u011fu gerek\u00e7eleri ile s\u00f6z konusu h\u00fckm\u00fcn Anayasaya ayk\u0131r\u0131 olmad\u0131\u011f\u0131na oybirli\u011fi ile karar verilmi\u015ftir.[53]\n<ol start=\"4\">\n \t<li><strong>\u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fmaya Dayal\u0131 \u0130\u015f S\u00f6zle\u015fmelerinin Sona Ermesi<\/strong><\/li>\n<\/ol>\n\u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmay\u0131 d\u00fczenleyen i\u015f s\u00f6zle\u015fmesi \u201c<em>belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesi olabilece\u011fi gibi objektif nedenlerin varl\u0131\u011f\u0131 halinde belirli s\u00fcreli i\u015f s\u00f6zle\u015fmesi de olabilir<\/em>.\u201d[54] Yarg\u0131tay bir karar\u0131nda i\u015f s\u00f6zle\u015fmesinin yap\u0131lmas\u0131n\u0131 gerektiren esasl\u0131 bir\u00a0 neden olmamas\u0131 gerek\u00e7esiyle \u00e7a\u011fr\u0131 \u00fczerinde \u00e7al\u0131\u015fmaya dayanan i\u015f s\u00f6zle\u015fmesinin belirsiz s\u00fcreli oldu\u011funa karar vermi\u015ftir.[55]\n\n\u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya d\u00fczenleyen i\u015f s\u00f6zle\u015fmeleri belirli yada belirsiz s\u00fcreli yap\u0131labilen k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmeleri olmas\u0131 sebebiyle i\u015fverenin \u00f6l\u00fcm\u00fc, taraflar\u0131n uzla\u015fmas\u0131, s\u00f6zle\u015fmenin belirli s\u00fcreli olmas\u0131 halinde s\u00fcrenin sona ermesi ile \u0130K m.17 vd\u2019 de yer alan\u00a0 h\u00fck\u00fcmler uyar\u0131nca s\u00fcreli, m.24-25 h\u00fck\u00fcmleri uyar\u0131nca derhal fesih edilebilecektir.[56]\n\n\u0130\u015fveren taraf\u0131ndan i\u015f s\u00f6zle\u015fmesinin feshi bildirilmedi\u011fi s\u00fcrece \u00e7a\u011fr\u0131 yapmasa bile s\u00f6zle\u015fmenin son bulmayaca\u011f\u0131 ve \u00e7a\u011fr\u0131lmayan i\u015f\u00e7iye \u00fccret \u00f6demesi \u0130K m.14\/f.2 uyar\u0131nca gerekir. Ancak i\u015fveren taraf\u0131ndan\u00a0 b\u00f6yle bir \u00f6demenin yap\u0131lmamas\u0131 durumunda i\u015f\u00e7inin \u0130K m.24\/II-e h\u00fckm\u00fcne g\u00f6re derhal fesih talebinde bulunmas\u0131 m\u00fcmk\u00fcn olacakt\u0131r.[57]\n\nDaha \u00f6nce ifade etti\u011fimiz gibi \u00e7a\u011fr\u0131 \u0130K m. 14\/f.3 uyar\u0131nca aksi kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a, i\u015f\u00e7inin \u00e7al\u0131\u015faca\u011f\u0131 zamandan en az d\u00f6rt g\u00fcn \u00f6nce yap\u0131lmas\u0131 gerekmektedir. \u00c7a\u011fr\u0131 i\u015fveren veya i\u015fveren vekilince yap\u0131labilecek olup \u00e7a\u011fr\u0131n\u0131n nas\u0131l yap\u0131laca\u011f\u0131n\u0131 taraflar serbest\u00e7e kararla\u015ft\u0131rabilirler.[58] Taraflarca belirlenmedi\u011fi taktirde \u00e7a\u011fr\u0131 i\u015fyerindeki\/i\u015fkolundaki ve i\u015fkolundaki mutad yollarla yap\u0131labilmesi m\u00fcmk\u00fcnd\u00fcr.[59]\n\n\u00c7a\u011fr\u0131 tek tarafl\u0131 varmas\u0131 gerekli yenilik do\u011furucu beyand\u0131r.[60] \u0130\u015fverenin s\u00fcresi i\u00e7inde ve ya belirlenen zamanda \u00e7a\u011fr\u0131 yapmamas\u0131ndan dolay\u0131 i\u015f\u00e7inin ge\u00e7 kalan veya yap\u0131lmayan \u00e7a\u011fr\u0131ya uyma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r.[61] Bu durumda i\u015f\u00e7iden yap\u0131lan \u00e7a\u011fr\u0131ya uymas\u0131 d\u00fcr\u00fcstl\u00fck kural\u0131 kapsam\u0131nda beklenemez ve i\u015f\u00e7i \u00fccrete hak kazan\u0131r.[62]\n\nD\u00f6rt g\u00fcnl\u00fck s\u00fcre \u00e7a\u011fr\u0131n\u0131n i\u015f\u00e7iye ula\u015fmas\u0131 ile ba\u015flar ve \u00e7a\u011fr\u0131n\u0131n i\u015f\u00e7iye ula\u015ft\u0131\u011f\u0131 g\u00fcn ile i\u015f\u00e7inin \u00e7al\u0131\u015fmaya ba\u015flad\u0131\u011f\u0131 g\u00fcn d\u00f6rt g\u00fcnl\u00fck s\u00fcrenin hesaplanmas\u0131nda dikkate al\u0131nmaz.[63]\n\nS\u00f6zle\u015fmeyle ya da \u0130\u015f Kanunda belirtilen s\u00fcreye uygun olarak \u00e7a\u011fr\u0131n\u0131n ula\u015ft\u0131\u011f\u0131 i\u015f\u00e7i, \u00e7a\u011fr\u0131 \u00fczerine i\u015f g\u00f6rme edimini ifa ile y\u00fck\u00fcml\u00fcd\u00fcr. Belirtilen y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davranan i\u015f\u00e7iye kar\u015f\u0131, i\u015fveren \u0130K m.25\/b. II (g\/h) uyar\u0131nca s\u00f6zle\u015fmeyi feshetme hakk\u0131na sahiptir.[64]\n<ol start=\"5\">\n \t<li><strong>\u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fmaya Dayal\u0131 \u0130\u015f S\u00f6zle\u015fmelerinin Sona Ermesinin Sonu\u00e7lar\u0131<\/strong><\/li>\n<\/ol>\n\u0130\u015f S\u00f6zle\u015fmesinin sona ermesi halinde bunun sonucu k\u0131dem ve ihbar tazminatlar\u0131na hak kazanma ve bunlar\u0131n hesaplanmas\u0131 \u00f6nemlidir.\n\n\u0130\u015f Kanunun gerek\u00e7esinde; k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerinin \u00f6zel bir uygulanma \u015fekli olan \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayal\u0131 i\u015f s\u00f6zle\u015fmelerine de \u0130K m.13\u2019de d\u00fczenlenen k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerine ili\u015fkin h\u00fck\u00fcmlerinin uygulanaca\u011f\u0131 belirtilmi\u015ftir.\u00a0 B\u00f6ylece kanun koyucuya g\u00f6re y\u0131ll\u0131k \u00fccretli izin, fazla \u00e7al\u0131\u015fma, k\u0131dem tazminat\u0131n\u0131n hesaplanmas\u0131nda k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerine ili\u015fkin d\u00fczenlemeler uygulanacakt\u0131r. Yarg\u0131tay\u2019\u0131n eski bir karar\u0131nda,\u00a0 \u201cihtiya\u00e7 olunca \u00e7a\u011fr\u0131lan ve haftan\u0131n belirlenmi\u015f g\u00fcnlerinde \u201cextra i\u015f\u00e7i\u201d olarak \u00e7al\u0131\u015fan s\u00fcrekli bir i\u015f\u00e7inin mevsimlik i\u015f\u00e7i say\u0131lamayaca\u011f\u0131, ihbar, k\u0131dem, k\u00f6t\u00fcniyet tazminatlar\u0131 ile izin \u00fccretine hak kazanaca\u011f\u0131 kabul edilmi\u015ftir.\n\n\u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya ili\u015fkin k\u0131dem tazminat\u0131 uygulamas\u0131n\u0131n nas\u0131l olaca\u011f\u0131na dair yap\u0131lm\u0131\u015f bir d\u00fczenleme yoktur. Ancak 1475 say\u0131l\u0131 \u0130\u015f Kanun\u2019un tek y\u00fcr\u00fcrl\u00fckte kalan maddesi olan 14 \u00fcnc\u00fc maddedeki k\u0131dem tazminat\u0131 konusu herhangi bir de\u011fi\u015fikli\u011fe u\u011framadan aynen kald\u0131\u011f\u0131 i\u00e7in \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmada da uygulanmaktad\u0131r.\n\nYarg\u0131tay, 2000 y\u0131l\u0131ndan sonra k\u0131dem s\u00fcresinin hesab\u0131nda\u00a0 i\u015f s\u00f6zle\u015fmesinin ba\u015flang\u0131c\u0131 ile sona ermesi aras\u0131ndaki \u00e7al\u0131\u015f\u0131lan ve \u00e7al\u0131\u015f\u0131lmayan ayr\u0131m\u0131 yapmaks\u0131z\u0131n t\u00fcm s\u00fcreleri dikkate alm\u0131\u015ft\u0131r.[65]\n\nYarg\u0131tay\u2019\u0131n di\u011fer bir karar\u0131nda \u201c\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmada son y\u0131lda \u00f6denen \u00fccret ve sair haklar\u0131n\u0131n toplanmas\u0131na ve bulunan miktar\u0131n 365\u2019e b\u00f6l\u00fcnerek bulunan g\u00fcnl\u00fck \u00fccretin, ihbar ve k\u0131dem tazminat\u0131 hesab\u0131nda nazara al\u0131nmas\u0131na\u201d karar verilmi\u015ftir.[66]\n\n<strong>C. \u0130\u015e PAYLA\u015eIMI (JOB SHARING):<\/strong>\n<ol>\n \t<li><strong>Genel Olarak<\/strong><\/li>\n<\/ol>\n\u0130\u015f payla\u015f\u0131m\u0131n\u0131n temeli 1960\u2019l\u0131 y\u0131llardaki ABD\u2019deki uygulamalara dayanmakta olup k\u0131smi bir \u00e7al\u0131\u015fma t\u00fcr\u00fcd\u00fcr.[67] \u0130\u015f Kanunumuzda k\u0131smi s\u00fcreli \u00e7al\u0131\u015fman\u0131n \u00f6zel bir t\u00fcr\u00fc olan \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya ili\u015fkin \u00f6zel bir d\u00fczenlemeye yer verilmesine ra\u011fmen i\u015f payla\u015f\u0131m\u0131na ili\u015fkin bir d\u00fczenlemeye yer verilmemi\u015ftir. Bizimde kat\u0131ld\u0131\u011f\u0131m\u0131z g\u00f6r\u00fc\u015fe g\u00f6re; kanun koyucu taraf\u0131ndan i\u015f payla\u015f\u0131m\u0131n\u0131n d\u00fczenlenmemesi bir eksikliktir.[68] \u00a0Ancak \u0130\u015f Kanun\u2019unun emredici h\u00fck\u00fcmlerine ayk\u0131r\u0131 olmamak \u015fart\u0131yla i\u015f payla\u015f\u0131m\u0131na ili\u015fkin s\u00f6zle\u015fmelerin yap\u0131lmamas\u0131na bir engel bulunmamaktad\u0131r.[69] Bu konuda Kanun gerek\u00e7esinde bu \u201c<em>Kanunda ayr\u0131ca h\u00fck\u00fcm bulunmamakla beraber, taraflar, \u00fclkemizde hen\u00fcz uygulamas\u0131na ge\u00e7ilmemi\u015f\u00a0 olan k\u0131smi s\u00fcreli s\u00f6zle\u015fmelerim \u00f6zel bir \u015fekli olan i\u015fin payla\u015f\u0131lmas\u0131 esas\u0131na dayal\u0131 t\u00fcr\u00fcn\u00fc de se\u00e7ebilirler<\/em>.\u201d\u00a0 \u015feklinde ifadeye yer verilmi\u015ftir.\n\n\u0130\u015f payla\u015f\u0131m\u0131; tam g\u00fcn \u00e7al\u0131\u015f\u0131lan bir i\u015fyerinde[70] i\u015f g\u00f6rme ediminin birden \u00e7ok say\u0131daki i\u015f\u00e7i taraf\u0131ndan payla\u015f\u0131l\u0131p yerine getirilmesidir.[71] \u00a0Alman \u0130stihdam\u0131 Te\u015fvik Kanununda i\u015f payla\u015f\u0131m\u0131 s\u00f6zle\u015fmesi m.5\u2019de tan\u0131mlanm\u0131\u015f olup s\u00f6z konusu maddeye g\u00f6re \u201c <em>\u015eayet i\u015fveren iki veya daha fazla i\u015f\u00e7i ile bir i\u015fyerindeki i\u015f s\u00fcresini payla\u015fmak konusunda anla\u015f\u0131rsa herhangi bir i\u015f\u00e7inin yoklu\u011funda di\u011fer i\u015f payla\u015fan i\u015f\u00e7iler gelmeyen i\u015f\u00e7inin yerine \u00e7al\u0131\u015fmay\u0131 kabul ettikleri taktirde onun yerine \u00e7al\u0131\u015fmak zorundalar<\/em>.\u201d [72]\n\n\u0130\u015f payla\u015f\u0131m\u0131n\u0131n de\u011fi\u015fik g\u00f6r\u00fcn\u00fcmlerde ortaya \u00e7\u0131kmas\u0131 m\u00fcmk\u00fcnd\u00fcr.[73] \u00d6rn: \u00fc\u00e7 i\u015f\u00e7i bir i\u015f yerinde g\u00fcndelik 10 saat \u00e7al\u0131\u015fmay\u0131 \u00fcstlenmi\u015f olup bunu kendi aralar\u0131nda belli saat aral\u0131klar\u0131na g\u00f6re payla\u015fabilecekleri gibi haftal\u0131k \u00e7al\u0131\u015fma g\u00fcnlerini de payla\u015fabilirler.\n<ol start=\"2\">\n \t<li><strong>Tak\u0131m S\u00f6zle\u015fmesinden Farklar\u0131<\/strong><\/li>\n<\/ol>\n\u0130\u015f payla\u015f\u0131m\u0131na ili\u015fkin s\u00f6zle\u015fmelerin tak\u0131m s\u00f6zle\u015fmeleri ile kar\u0131\u015ft\u0131r\u0131lmamas\u0131 gerekmektedir. Hem tak\u0131m s\u00f6zle\u015fmesinde[74] hem de i\u015f payla\u015f\u0131m\u0131 s\u00f6zle\u015fmesinde birden fazla i\u015f\u00e7inin \u00e7al\u0131\u015fmas\u0131 s\u00f6z konusu oldu\u011fu i\u00e7in ilk bak\u0131\u015fta benzer olduklar\u0131 d\u00fc\u015f\u00fcn\u00fclse de hukuki a\u00e7\u0131dan \u00f6nemli farklar bulunmaktad\u0131r.[75]\n\n\u0130\u015f payla\u015f\u0131m\u0131nda ama\u00e7, bir tam g\u00fcnl\u00fc i\u015fin payla\u015f\u0131larak yap\u0131lmas\u0131 s\u00f6z konusu olmas\u0131na ra\u011fmen tak\u0131m s\u00f6zle\u015fmesinde b\u00f6yle bir ama\u00e7 yoktur.[76]\n\n\u0130\u015f payla\u015f\u0131m\u0131nda i\u015f\u00e7i ile i\u015fveren aras\u0131nda ayr\u0131 ayr\u0131 hizmet s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 kabul edilir,ancak bir hizmet s\u00f6zle\u015fmesi mevcut olup her bir i\u015f\u00e7i taraf\u0131ndan ayr\u0131 ayr\u0131 imzalan\u0131r. Tak\u0131m s\u00f6zle\u015fmelerinde ise tak\u0131mdan bir i\u015f\u00e7i tak\u0131m\u0131 temsilen hizmet s\u00f6zle\u015fmesi yapar ve tak\u0131mdaki di\u011fer i\u015f\u00e7iler ad\u0131na yapt\u0131\u011f\u0131 s\u00f6zleme tak\u0131m\u0131n di\u011fer \u00fcyelerini de ba\u011flar ve o i\u015f\u00e7i ile i\u015fveren aras\u0131nda do\u011frudan yap\u0131lm\u0131\u015f say\u0131l\u0131r.\n\n\u0130\u015f payla\u015f\u0131mda \u00fccret talebi birden fazla i\u015f\u00e7iden olu\u015fan gruba ait olup i\u015f\u00e7ilerden biri \u00fccretin payla\u015f\u0131m\u0131n\u0131 talep edebilir,tak\u0131m s\u00f6zle\u015fmesinde ise i\u015fverenin tak\u0131m\u0131 olu\u015fturan i\u015f\u00e7ilere ayr\u0131 ayr\u0131 \u00f6demesi gerekir.[77]\n<ol start=\"3\">\n \t<li><strong>\u0130\u015f Payla\u015f\u0131m\u0131 S\u00f6zle\u015fmesinin \u00d6zellikleri<\/strong><\/li>\n<\/ol>\n\u0130\u015f payla\u015f\u0131m\u0131n\u0131n en \u00f6nemli ay\u0131rt edici \u00f6zelli\u011fi; i\u015f s\u00fcresinin gerek devaml\u0131l\u0131k, gerekse i\u015fin ba\u015flang\u0131\u00e7 ve biti\u015f zamanlar\u0131 konular\u0131nda i\u015fverene ba\u011f\u0131ml\u0131l\u0131\u011f\u0131n\u0131n ortadan kalkmas\u0131d\u0131r.[78] Ancak i\u015f ili\u015fkisinin ba\u015f\u0131nda i\u015f\u00e7iler kimin ne zaman ne kadar \u00e7al\u0131\u015faca\u011f\u0131n\u0131 belirlemekte olup bunu i\u015fverene bildirirler ve buna uymamalar\u0131 halinde i\u015f s\u00f6zle\u015fmesinin feshi sonucu ortaya \u00e7\u0131kabilir.[79]\n\n\u0130\u015f payla\u015f\u0131m\u0131nda belirleyici bir di\u011fer \u00f6zellik ise iki ki\u015fiden biri, di\u011feri gelmedi\u011fi taktirde onun i\u015fini yapabilecek nitelikte olmas\u0131d\u0131r.[80]\n\nAncak i\u015f\u00e7ilerden biri taraf\u0131ndan i\u015f g\u00f6rme ediminin yerine getirilmemesi halinde di\u011fer i\u015f\u00e7ilerin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmeyen i\u015f\u00e7inin yerine ge\u00e7erek bu borcu yerine getirmesi beklenemez.[81] Ancak s\u0131n\u0131rl\u0131 olmak kayd\u0131 ile s\u00f6zle\u015fme ile yerine ge\u00e7me borcu d\u00fczenlenebilir.[82] \u00a0S\u00f6zle\u015fmede b\u00f6yle bir d\u00fczenlemenin yer almas\u0131n\u0131n yasall\u0131\u011f\u0131 i\u015f payla\u015f\u0131m anla\u015fmas\u0131n\u0131n geni\u015f uygulama alan\u0131 buldu\u011fu Almanya\u2019da tart\u0131\u015fmalara yol a\u00e7m\u0131\u015ft\u0131r.[83] \u0130\u015f\u00e7inin bu s\u00f6zle\u015fme ile amac\u0131 belirli zaman\u0131 serbet\u00e7e ge\u00e7irmeyi ama\u00e7lad\u0131\u011f\u0131 i\u00e7in i\u015f payla\u015f\u0131m\u0131 s\u00f6zle\u015fmesinin ruhuna ayk\u0131r\u0131 d\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc savunanlar oldu\u011fu gibi s\u00f6zle\u015fme serbesti uyar\u0131nca\u00a0 ba\u015ftan bir taahh\u00fct oldu\u011fu i\u00e7in i\u015f\u00e7i a\u00e7\u0131s\u0131ndan b\u00f6yle bir y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn alt\u0131na girmelerinin m\u00fcmk\u00fcn oldu\u011funu savunanlarda bulunmaktad\u0131r.[84]\n\n\u0130\u015f payla\u015f\u0131m s\u00f6zle\u015fmelerinde t\u00fcm\u00a0 i\u015f\u00e7iler ayn\u0131 i\u015f yeri i\u00e7in bir tam g\u00fcn \u00e7al\u0131\u015fan i\u015f\u00e7inin i\u015f s\u00fcresi oran\u0131nda sorumludur.[85] \u00d6rn.i\u015f payla\u015f\u0131m\u0131 s\u00f6zle\u015fmesindeki i\u015f\u00e7ilerin toplam \u00e7al\u0131\u015fma s\u00fcresi haftal\u0131k 45 saati ge\u00e7emez.\n<ol start=\"4\">\n \t<li><strong>\u0130\u015f Payla\u015f\u0131m\u0131 S\u00f6zle\u015fmesinin \u0130\u015f\u00e7i ve \u0130\u015fveren A\u00e7\u0131s\u0131ndan Olumlu\/Olumsuz Yanlar\u0131:<\/strong><\/li>\n<\/ol>\n<ol>\n \t<li><strong>\u0130\u015f Payla\u015f\u0131m\u0131 S\u00f6zle\u015fmesinin \u0130\u015f\u00e7i ve \u0130\u015fveren A\u00e7\u0131s\u0131ndan Olumlu Yanlar\u0131<\/strong><\/li>\n<\/ol>\n\u0130\u015f payla\u015f\u0131m\u0131 s\u00f6zle\u015fmelerinin hem i\u015f\u00e7i hem de i\u015fveren a\u00e7\u0131s\u0131ndan olumlu yanlar\u0131 bulunmaktad\u0131r:\n<ul>\n \t<li>Tam g\u00fcn s\u00fcreli \u00e7al\u0131\u015fmaya g\u00f6re i\u015f payla\u015f\u0131m\u0131nda verimlilik daha y\u00fcksektir. \u0130\u015f payla\u015f\u0131m\u0131nda i\u015f\u00e7ilerin daha k\u0131sa s\u00fcreli \u00e7al\u0131\u015fmalar\u0131 nedeniyle i\u015f\u00e7iler daha din\u00e7 ve dinamik olaca\u011f\u0131ndan dolay\u0131 daha fazla verimli olacaklard\u0131r. [86]<\/li>\n \t<li>\u0130\u015f\u00e7iler daha az \u00e7al\u0131\u015ft\u0131klar\u0131 i\u00e7in daha az yorulacaklard\u0131r.<\/li>\n \t<li>\u0130\u015f payla\u015f\u0131m\u0131n\u0131n varl\u0131\u011f\u0131 halinde ki\u015finin \u00f6zel i\u015flerini yapacak bo\u015f zaman\u0131 yeterli derecede oldu\u011fu i\u00e7in i\u015ften izin alma olay\u0131n\u0131 azaltarak i\u015fletmede verimlili\u011fi artt\u0131racakt\u0131r.<\/li>\n \t<li>\u0130\u015f payla\u015f\u0131m\u0131n\u0131n di\u011fer bir olumlu yan\u0131 ise birden fazla \u00a0i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131\u011f\u0131ndan, i\u015fveren iki ki\u015finin yetene\u011finden ve bilgisinden yararlanabilecektir. B\u00f6ylece verimlilik d\u00fc\u015fecektir.<\/li>\n \t<li>Daha fazla \u00e7al\u0131\u015fan\u0131n olmas\u0131 sebebiyle y\u00f6netim zorluklar\u0131 ortaya \u00e7\u0131kabilir.<\/li>\n<\/ul>\n<strong>\u00a0<\/strong>\n\n<strong>\u00a0 D.Ba\u015fka \u0130\u015fte \u00c7al\u0131\u015fma-\u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fma-\u0130\u015f Payla\u015f\u0131m\u0131 S\u00f6zle\u015fmelerinde Soysal \u00a0<\/strong><strong>G\u00fcvenlik<\/strong>\n\nK\u0131smi s\u00f6zle\u015fmelerin \u00f6zel t\u00fcrleri olan \u201cba\u015fka i\u015fte \u00e7al\u0131\u015fma\u201d, \u201c\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma\u201d,\u201d i\u015f payla\u015f\u0131m\u0131\u201d kapsam\u0131nda \u00e7al\u0131\u015fan i\u015f\u00e7ilerin sosyal sigorta haklar\u0131 konusunda \u00f6zel bir d\u00fczenleme bulunmamakla beraber bu t\u00fcr s\u00f6zle\u015fmelere yasan\u0131n gerek\u00e7esinden de anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerine ili\u015fkin genel h\u00fck\u00fcmler uygulanacakt\u0131r.[87] Bu durum sosyal sigorta haklar\u0131 bak\u0131m\u0131ndan da ge\u00e7erli olacakt\u0131r.\n\nSSK m.2 uyar\u0131nca \u201cBir hizmet akdine dayanarak bir veya birka\u00e7 i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015ft\u0131r\u0131lan bu kanuna g\u00f6re sigortal\u0131 say\u0131l\u0131rlar.\u201d\n\nBu ba\u011flamda k\u0131smi s\u00fcreli i\u015fte \u00e7al\u0131\u015fanlar ile tam g\u00fcn \u00e7al\u0131\u015fanlar aras\u0131nda sosyal sigorta haklar\u0131ndan yararlanma konusunda farkl\u0131l\u0131k bulunmamaktad\u0131r.[88] Ancak SSK, t\u00fcm \u00e7al\u0131\u015fanlar\u0131n sigortal\u0131 olarak kabul etmemektedir. \u00d6rn.; bir ev hizmetinde \u00e7al\u0131\u015fanlar \u00fccretle ve s\u00fcrekli olarak \u00e7al\u0131\u015fm\u0131yorlarsa bu kanun kapsam\u0131nda de\u011fildir. Bu durum s\u00fcrekli olmayarak ge\u00e7ici olarak \u00e7al\u0131\u015fan, ama her g\u00fcn \u00e7al\u0131\u015fan g\u00fcndelik\u00e7i i\u015f\u00e7ilerin aleyhinedir.\n\nBu kanun kapsam\u0131nda k\u0131smi \u00e7al\u0131\u015fanlar\u0131n da i\u015fe ba\u015flad\u0131\u011f\u0131 tarihten itibaren sigortal\u0131klar\u0131 ba\u015flar.Sigortal\u0131l\u0131k s\u00fcresinin hesab\u0131nda i\u015f\u00e7inin ilk i\u015fe giri\u015f tarihi ile tahsis talebinde bulundu\u011fu tarih aras\u0131ndaki s\u00fcre dikkate al\u0131n\u0131r, bir ba\u015fka ifade ile k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7inin sadece \u00e7al\u0131\u015ft\u0131\u011f\u0131 g\u00fcnlerin toplam\u0131 dikkate al\u0131narak hesaplanmaz.[89] Sosyal Sigortalar Kurumu taraf\u0131ndan yay\u0131nlanan 16-318 EK Say\u0131l\u0131 Genelge ile k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fanlar\u0131n sosyal sigorta primlerinin nas\u0131l hesaplanaca\u011f\u0131 belirtilmi\u015ftir.[90]\n\nKural olarak k\u0131smi s\u00fcreli \u00e7al\u0131\u015fanlar\u0131n sigorta bildirimleri tam s\u00fcreli \u00e7al\u0131\u015fan bir i\u015f\u00e7inin 7.5 saat olan g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresine g\u00f6re belirlenir.[91] Buna g\u00f6re k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesine dayanarak yap\u0131lan \u00e7al\u0131\u015fmalarda ay i\u00e7erisindeki her 7.5 saatlik \u00e7al\u0131\u015fma s\u00fcresi 1 g\u00fcn kabul edilecektir.[92] Primlerin hesab\u0131na esas tutulan g\u00fcnl\u00fck kazanc\u0131n alt s\u0131n\u0131r\u0131 ile \u00fcst s\u0131n\u0131r\u0131 SSK m.78\u2019e g\u00f6re belirlenecektir. K\u0131smi s\u00fcreli veya \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fanlarda 30 g\u00fcnden az \u00e7al\u0131\u015fan sigortal\u0131lar\u0131n eksik g\u00fcnlerine ait genel sa\u011fl\u0131k sigortas\u0131 primleri 30 g\u00fcne tamamlanmal\u0131d\u0131r.[93]\n\n\u00c7a\u011fr\u0131 \u00fczerinde \u00e7al\u0131\u015fan i\u015f\u00e7iye s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan s\u00fcrede ister \u00e7al\u0131\u015ft\u0131r\u0131ls\u0131n ister a\u00e7l\u0131\u015ft\u0131r\u0131lmas\u0131n prim \u00f6deyecektir.s\u00f6zle\u015fmde kararla\u015ft\u0131r\u0131lan miktardan daha fazka i\u015f\u00e7i \u00e7al\u0131\u015f\u0131rsa s\u00f6zle\u015fmede kararla\u015ft\u0131rlan \u00fczerinden de\u011fil fiili \u00e7al\u0131\u015fan s\u00fcre dikkate al\u0131narak pr,m \u00f6dencektir.[94] Kaanatimizce hakl\u0131 olarak yap\u0131lan ele\u015ftiri yernde bir ele\u015ftiridir.[95]\u015e\u00f6yle ki; \u00a0\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fan bir i\u015f\u00e7inin ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131na hk kazanmas\u0131 neredesyse imkans\u0131zd\u0131r.En az haftada 20 saat \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fan i\u015f\u00e7inin ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131na hak kazanabilmesi i\u00e7i 7000 g\u00fcn prim ko\u015fulunu yakla\u015f\u0131k 50 y\u0131l \u00e7al\u0131\u015farak ger\u00e7ekle\u015ftirebilecektir.\n\nAyr\u0131ca SSK kanunu kapsam\u0131nda al\u0131nacak primlerin hesab\u0131na esas tutulan g\u00fcnl\u00fck kazan\u00e7 i\u015f\u00e7i g\u00fcnde birka\u00e7 saat \u00e7al\u0131\u015fm\u0131\u015f olsa bile asgari g\u00fcnl\u00fck kazan\u00e7 \u00fczerinden g\u00f6sterilmelidir.[96]\n\nSSK m. 77 g\u00f6re \u201cBir ay i\u00e7inde \u00e7e\u015fitli i\u015fverenlerin i\u015finde \u00e7al\u0131\u015fan sigortal\u0131n\u0131n bu kanun gere\u011fince al\u0131nacak primlerine esas tutulacak ayl\u0131k ve g\u00fcnl\u00fck kazanc\u0131n\u0131n tesbitinde her i\u015fverenden elde etti\u011fi ayl\u0131k ve g\u00fcnl\u00fck kazan\u00e7 tutar\u0131 ayr\u0131 ayr\u0131 nazara al\u0131n\u0131r ve primler buna g\u00f6re hesaplan\u0131r.\u201d Bu primlerin \u00f6denme \u015fekli ise yine ayn\u0131 Kanun m.73 de belirtilmi\u015f olup i\u015f\u00e7i ile i\u015fveren taraf\u0131ndan \u00f6denir. Ancak i\u015fveren taraf\u0131ndan \u00f6denecek tutar i\u015f\u00e7inin \u00f6deyece\u011fi orana g\u00f6re fazla oldu\u011fundan dolay\u0131 i\u015fverenler k\u0131smi \u00e7al\u0131\u015fanlar\u0131 sigortalatt\u0131rmamak yolunu se\u00e7mektedir.[97] Bunun sonucunda i\u015f\u00e7inin soysal g\u00fcvenceden yoksun kalmas\u0131 sonucu ortaya \u00e7\u0131kar\u0131r. Bu nedenle k\u0131smi s\u00fcreli \u00e7al\u0131\u015fanlara ili\u015fkin yasal\u00a0 d\u00fczenlemenin tekrar\u00a0\u00a0\u00a0\u00a0\u00a0 d\u00fczenlenmesi kanaatindeyiz.\n\nBunlar\u0131n yan\u0131 s\u0131ra SSK k\u0131smi s\u00fcreli i\u015flerde \u00e7al\u0131\u015fanlara ili\u015fkin \u00f6zel d\u00fczenlemelere yer vermemi\u015ftir. Bu nedenle k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7iler ile tam g\u00fcn \u00e7al\u0131\u015fan i\u015f\u00e7iler ayn\u0131 sosyal sigorta yard\u0131mlar\u0131ndan yararlanacakt\u0131r.\n<h1 data-fontsize=\"36\" data-lineheight=\"48\"><\/h1>\n<h3 data-fontsize=\"24\" data-lineheight=\"24\">SONU\u00c7<\/h3>\n\u00c7al\u0131\u015fma hayat\u0131nda, uygulanma alan\u0131 giderek yayg\u0131nla\u015fan\u00a0 \u201c<strong>ba\u015fka (yan) i\u015fte \u00e7al\u0131\u015fma<\/strong>\u201d, \u201c<strong>\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma<\/strong> (work- on call)\u201d, \u201c<strong>i\u015f payla\u015f\u0131m\u0131<\/strong> (job sharing)\u201d\u00a0 s\u00f6zle\u015fmeleri k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerinin \u00f6zel uygulama \u015fekilleridir.\n\n1475 say\u0131l\u0131 \u0130\u015f Kanunun\u2019da yer almayan \u201c<strong>\u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma\u201d\u00a0 <\/strong>\u00e7al\u0131\u015fma hayat\u0131n\u0131n de\u011fi\u015fmesine ba\u011fl\u0131 olarak 4857 say\u0131l\u0131 \u0130\u015f Kanununda yer alm\u0131\u015ft\u0131r. B\u00f6ylece \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya dayanan hizmet s\u00f6zle\u015fmesinin ko\u015fullar\u0131 belirlenmi\u015ftir. Ancak \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaya ili\u015fkin k\u0131dem tazminat\u0131n\u0131n uygulanmas\u0131 hakk\u0131nda bir d\u00fczenleme getirilmemi\u015ftir. Uygulamadaki \u00e7eli\u015fkileri ortadan kald\u0131rmak amac\u0131yla \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmada k\u0131dem tazminat\u0131n\u0131 d\u00fczenlenmesi gerekmektedir. Ayr\u0131ca 4857 say\u0131l\u0131 \u0130\u015f Kanununda \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmay\u0131 d\u00fczenleyen maddenin Anayasaya ayk\u0131r\u0131 oldu\u011funun ileri s\u00fcr\u00fclmesi sonucunda Anayasa Mahkemesi taraf\u0131ndan ilgili maddenin Anayasaya ayk\u0131r\u0131 olmad\u0131\u011f\u0131na karar verilmi\u015ftir.\n\nUygulamada g\u00f6r\u00fclen di\u011fer s\u00f6zle\u015fme t\u00fcrlerinden \u201c<strong>i\u015f payla\u015f\u0131m\u0131<\/strong> (job sharing)\u201d\u00a0 ve \u201c<strong>ba\u015fka i\u015fte \u00e7al\u0131\u015fma<\/strong>\u201d ya ili\u015fkin d\u00fczenlemelere 4857 say\u0131l\u0131 \u0130\u015f Kanununda yer verilmemi\u015ftir. Ancak k\u0131smi \u00e7al\u0131\u015fman\u0131n \u00f6zel bir \u015fekli olan bu s\u00f6zle\u015fme tiplerinin uygulanmas\u0131nda kanunen bir engel bulunmamakla beraber bu s\u00f6zle\u015fme t\u00fcrlerine k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmeleirne ili\u015fkin h\u00fck\u00fcmler uygulanacakt\u0131r.
