Ancak arsa sahibi ve y\u00fcklenici m\u00fcteahhidin her ikisinin de T\u00fcrk Ticaret Kanunu uyar\u0131nca tacir s\u0131fat\u0131n\u0131 haiz olmalar\u0131 halinde s\u00f6z konusu uyu\u015fmazl\u0131k bak\u0131m\u0131ndan g\u00f6revli mahkeme Asliye Ticaret Mahkemesi olacakt\u0131r.<\/span>\n\n<span style=\"font-weight: 400;\">Yetkili mahkemenin tespiti noktas\u0131nda kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi bak\u0131m\u0131ndan uyu\u015fmazl\u0131\u011f\u0131n t\u00fcr\u00fcne bakmak gerekir. \u00d6rne\u011fin ta\u015f\u0131nmaz\u0131n m\u00fclkiyetinin devrinden kaynaklanan bir uyu\u015fmazl\u0131k varsa o halde ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesi yetkilidir.
