S\u00f6zl\u00fc anla\u015fma da yeterli olmaktad\u0131r. Ancak kar\u015f\u0131l\u0131kl\u0131 olarak imzalanan s\u00f6zle\u015fmeler hukuki a\u00e7\u0131dan daha ge\u00e7erli say\u0131l\u0131r. S\u00f6zle\u015fme noter huzurunda da yap\u0131labilir.<\/p>\n\n\n\n<p><strong>Konut kiras\u0131: <\/strong>Konut, ki\u015filerin devaml\u0131 veya ge\u00e7ici olarak yerle\u015fmek veya bar\u0131nmak amac\u0131yla oturmalar\u0131na elveri\u015fli yerlerdir. Bir yerin konut olarak de\u011ferlendirilme \u015fart\u0131 ki\u015fiyi d\u0131\u015far\u0131dan gelecek etkilere kar\u015f\u0131 bir koruma sa\u011flamas\u0131d\u0131r. Bu y\u00fczden \u00e7ad\u0131r veya baraka tarz\u0131 yerler konut kiras\u0131na konu olamazlar.<\/p>\n\n\n\n<h2>Kira S\u00f6zle\u015fmesi S\u00fcresi<\/h2>\n\n\n\n<p>Kira s\u00f6zle\u015fmeleri belirli veya belirsiz bir s\u00fcre i\u00e7in yap\u0131labilir. E\u011fer s\u00f6zle\u015fme \u00fczerinde yazm\u0131yorsa s\u00f6zle\u015fmenin s\u00fcresi bir senedir. Kirac\u0131, kira s\u00f6zle\u015fmesinin bitimine 15 g\u00fcn kala yaz\u0131l\u0131 olarak fesih bildiriminde bulunarak kira s\u00f6zle\u015fmesini sonland\u0131rabilir. Kiraya veren s\u00f6zle\u015fmenin s\u00fcresinin bitimine dayanarak kira s\u00f6zle\u015fmesini sona erdiremez. Kiraya verenin kirac\u0131y\u0131 evden \u00e7\u0131karmak i\u00e7in fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdiremese de s\u00f6zle\u015fmeyi sonland\u0131rma hakk\u0131n\u0131n bulundu\u011fu baz\u0131 durumlar vard\u0131r. Kiraya verenin S\u00f6zle\u015fmeyi sonland\u0131rma hakk\u0131n\u0131n oldu\u011fu durumlar olsa bile hukuk sistemimizde kira s\u00f6zle\u015fmesini sonland\u0131rabilece\u011fi tek y\u00f6ntem \u201ctahliye davas\u0131\u201dd\u0131r.<\/p>\n\n\n\n<h2>Kirac\u0131n\u0131n Tahliyesinin Sebepleri<\/h2>\n\n\n\n<p>TBK h\u00fck\u00fcmleri genellikle kirac\u0131y\u0131 korumaktad\u0131r. Bu nedenle kiraya verenin kirac\u0131y\u0131 evden \u00e7\u0131karmak i\u00e7in hakl\u0131 bir nedeni olu\u015fmam\u0131\u015fsa kirac\u0131 da 15 g\u00fcn \u00f6nceden kira s\u00f6zle\u015fmesini sonland\u0131raca\u011f\u0131n\u0131 bildirmemi\u015fse kirac\u0131y\u0131 evden \u00e7\u0131karmak m\u00fcmk\u00fcn olmaz. Kanunun kirac\u0131y\u0131 koruyucu yap\u0131s\u0131 gere\u011fi a\u015fa\u011f\u0131daki nedenler aran\u0131r.<\/p>\n\n\n\n<h3>a)Kiraya Verenden Kaynaklanan<\/h3>\n\n\n\n<p><strong>1.\u0130htiya\u00e7 Sebebiyle: <\/strong>Kiraya veren, kiralanan\u0131, kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa kira s\u00f6zle\u015fmesini, s\u00f6zle\u015fme s\u00fcresinin sonundan itibaren bir ay i\u00e7inde Sulh Hukuk Mahkemesinde a\u00e7aca\u011f\u0131 davayla sona erdirebilir. Kiraya veren, dava a\u00e7aca\u011f\u0131n\u0131, en ge\u00e7 dava a\u00e7ma s\u00fcresi i\u00e7inde kirac\u0131ya bildirmi\u015fse dava a\u00e7ma s\u00fcresi kira y\u0131l\u0131n\u0131n sonuna kadar uzam\u0131\u015f say\u0131l\u0131r.<\/p>\n\n\n\n<p>Kiraya veren, gereksinim sebebiyle kiralanan\u0131n tahliyesi sa\u011fland\u0131\u011f\u0131nda, hakl\u0131 bir sebep olmadan aradan 3 y\u0131l ge\u00e7medik\u00e7e kiralanan\u0131 eski kirac\u0131s\u0131ndan ba\u015fka kimseye kiralayamaz.<\/p>\n\n\n\n<p><strong>2.Yeniden \u0130n\u015fa ve \u0130mar Sebebiyle: <\/strong>Kiraya veren, kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla asl\u0131 onar\u0131m\u0131, geni\u015fletilmesi, de\u011fi\u015ftirilmesi gerekli ve bu s\u0131rada kiralanan\u0131n kullan\u0131m\u0131 imkans\u0131z ise , kira s\u00f6zle\u015fmesini Sulh Hukuk Mahkemesinde a\u00e7aca\u011f\u0131 davayla sona erdirebilir. Bu davada yap\u0131lacak olan yeniden in\u015fa veya kapsaml\u0131 tamir ve tadilata ili\u015fkin projenin mahkemeye sunulmas\u0131 gerekir. Bu projeye dayan\u0131larak teknik bilirki\u015filer taraf\u0131ndan yap\u0131lacak ke\u015fif sonucunda kiraya verilenin, binan\u0131n kullan\u0131lamayaca\u011f\u0131 kesinle\u015firse tahliyeye karar verilir.<\/p>\n\n\n\n<p>Bu davan\u0131n da a\u00e7\u0131lma s\u00fcresi yine ihtiya\u00e7 nedeniyle tadilatta oldu\u011fu gibi s\u00f6zle\u015fme s\u00fcresinin sonundan itibaren 1 ayd\u0131r.<\/p>\n\n\n\n<p>Eski kirac\u0131n\u0131n, yeniden in\u015fa ve imar\u0131 ger\u00e7ekle\u015ftirilen ta\u015f\u0131nmazlar\u0131, yeni durumu ve yeni kira bedeliyle kiralama konusunda \u00f6ncelik hakk\u0131 bulunmaktad\u0131r. Bu hakk\u0131n, kiraya verenin yapaca\u011f\u0131 yaz\u0131l\u0131 bildirimden itibaren 6 ay i\u00e7inde kullan\u0131lmas\u0131 gerekir; bu \u00f6ncelik hakk\u0131 sona ermeden kiralayan, kiralanan\u0131,3 y\u0131l ge\u00e7meden bir ba\u015fkas\u0131na kiralayamaz.<\/p>\n\n\n\n<p><strong>3.Yeni Malikin \u0130htiyac\u0131 Sebebiyle: <\/strong>Kiralanan\u0131 sonradan edinen ki\u015fi, kiralanan\u0131, kendisi, e\u015fi, altsoyu, \u00fcstsoyu ya da kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa kira s\u00f6zle\u015fmesini, edinme tarihinden itibaren 1 ay i\u00e7inde durumu kirac\u0131ya bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini 6 ay i\u00e7inde Sulh Hukuk Mahkemesinde a\u00e7aca\u011f\u0131 bir davayla sonland\u0131rabilir. Yeni malikin ihtiyac\u0131 sebebiyle a\u00e7\u0131lan davada ihtiya\u00e7 sebebiyle a\u00e7\u0131lacak tahliye davas\u0131ndan farkl\u0131 olarak kira s\u00f6zle\u015fmesinin s\u00fcresinin bitmesinin beklenmesine gerek yoktur.<\/p>\n\n\n\n<p>Sonradan edimi kazanan ki\u015fi gereksinim haricinde keyfi sebeplere dayanarak kira s\u00f6zle\u015fmesinin feshi ve kirac\u0131y\u0131 evden \u00e7\u0131karma hakk\u0131 kazanmaz.<\/p>\n\n\n\n<p>Kiraya veren, bu h\u00fck\u00fcmlere ayk\u0131r\u0131 davrand\u0131\u011f\u0131 s\u00fcrece, eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6denmi\u015f bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fc olacakt\u0131r.<\/p>\n\n\n\n<h3>b) Kirac\u0131dan Kaynaklanan Haller<\/h3>\n\n\n\n<p><strong>1.Yaz\u0131l\u0131 Tahliye Taahh\u00fcd\u00fc Nedeniyle: <\/strong>Kirac\u0131, Kiralanan\u0131 teslim ald\u0131ktan sonra, kiraya verene y\u00f6nelik, kiralanan\u0131 yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc vermi\u015f olmas\u0131na ra\u011fmen bo\u015faltmam\u0131\u015fsa kiraya veren, bu tarihten itibaren kira s\u00f6zle\u015fmesini 1 ay i\u00e7inde icraya ba\u015fvurarak ya da dava a\u00e7arak sonland\u0131rabilir. Dikkat edilmesi gereken husus yaz\u0131l\u0131 taahh\u00fcd\u00fcn kiralanan\u0131n tesliminden sonra verilmesidir. Tahliye taahh\u00fctleri kesinlikle yaz\u0131l\u0131 olmal\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>2.Kira Bedelinin \u00d6denmemesi Sebebiyle: <\/strong>Kirac\u0131, kiralanan\u0131n tesliminden sonra muaccel olan kira borcunu yerine getirmezse kiraya veren kirac\u0131ya yaz\u0131l\u0131 bir \u015fekilde en az 30 g\u00fcnl\u00fck bir s\u00fcre verip bu s\u00fcre i\u00e7erisinde de borcunu \u00f6dememesi durumunda s\u00f6zle\u015fmeyi tahliye davas\u0131 yoluyla sonland\u0131rabilir.<\/p>\n\n\n\n<p>Yaz\u0131l\u0131 bildirim noter kanal\u0131yla ihtarname ile yap\u0131labilece\u011fi gibi icra dairesi yoluyla \u00f6deme emri g\u00f6ndererek de yapabilir. \u0130cra dairesinden \u00f6deme emri g\u00f6nderildi\u011finde tahliye davas\u0131 \u0130cra Hukuk Mahkemesine a\u00e7\u0131l\u0131r.<\/p>\n\n\n\n<p><strong>3.\u0130ki Hakl\u0131 \u0130htar Sebebiyle: <\/strong>Kirac\u0131, bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde bir kira y\u0131l\u0131 i\u00e7erisinde kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine yaz\u0131l\u0131 olarak iki kere hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden itibaren 1 ay i\u00e7inde tahliye davas\u0131 yoluyla kira s\u00f6zle\u015fmesini sona erdirebilir.\u00a0 \u00d6denmemi\u015f kira bedellerine ili\u015fkin yap\u0131lan icra takibine y\u00f6nelik \u00f6deme emirleri de ihtar yerini ge\u00e7er.<\/p>\n\n\n\n<p><strong>4.Kirac\u0131n\u0131n Kullanabilece\u011fi Ba\u015fka Konutunun Bulunmas\u0131: <\/strong>Kirac\u0131n\u0131n veya e\u015finin ayn\u0131 il\u00e7e veya belde s\u0131n\u0131rlar\u0131 i\u00e7erisinde oturmaya elveri\u015fli konutu varsa kiraya veren, s\u00f6zle\u015fme yap\u0131ld\u0131\u011f\u0131 s\u0131rada bunu bilmiyorsa, s\u00f6zle\u015fmenin bitiminden bir ay i\u00e7inde s\u00f6zle\u015fmeyi tahliye davas\u0131 yoluyla sona erdirebilir. Kirac\u0131n\u0131n sahibi oldu\u011fu konut oturmaya elveri\u015fli de\u011filse, hukuken ge\u00e7erli mazeretleri varsa tahliye edilemez.<\/p>\n\n\n\n<p><strong>5.\u00d6zenle Kullanma ve Kom\u015fulara Sayg\u0131 Borcu: <\/strong>Kirac\u0131, kiralanan\u0131 s\u00f6zle\u015fmeye uygun olarak \u00f6zenle kullanma ve kiralanan\u0131n bulundu\u011fu ta\u015f\u0131nmazda oturan kom\u015fular\u0131na kar\u015f\u0131 sayg\u0131l\u0131 olma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc vard\u0131r. Kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 hareket etmesi halinde kiraya veren, en az 30 g\u00fcn s\u00fcre vererek ayk\u0131r\u0131l\u0131\u011f\u0131n giderilmesini ister, aksi halde s\u00f6zle\u015fmeyi feshedece\u011fi konusunda yaz\u0131l\u0131 bir ihtarda bulunur.<\/p>\n\n\n\n<h2>Kirac\u0131n\u0131n Konutu Terk Etmemesi Durumunda:<\/h2>\n<p><br \/>Kirac\u0131, kiralanan \u00fczerinde yukar\u0131da da belirtti\u011fimiz sebeplerle g\u00f6nderilen ihtarnameye ra\u011fmen gerekli tahliye i\u015flemlerini ger\u00e7ekle\u015ftirmezse m\u00fclk sahibinin bu durumda yapmas\u0131 gereken \u015fey Tahliye Davas\u0131 a\u00e7arak kirac\u0131n\u0131n tahliye i\u015flemini ger\u00e7ekle\u015ftirmelidir.
